1. Definitions
"Company", "We", "Us", "Our" refers to BrilliantFix Limited, the owner and operator of BrilliantFixCalls™.
"Service" means the AI-powered telephone receptionist service provided through the BrilliantFixCalls™ platform, including all associated software, infrastructure, and features.
"Client" refers to any business or individual who subscribes to the BrilliantFixCalls™ Service.
"End User" or "Caller" refers to any person who contacts a Client's dedicated BrilliantFixCalls™ number.
"Platform" means the BrilliantFixCalls.com website, client portal, admin dashboard, and all related web applications.
"Subscription" means the recurring monthly payment arrangement granting access to the Service.
"Dedicated Number" means the unique telephone number assigned to a Client for exclusive use with the Service.
2. Description of Service
BrilliantFixCalls™ provides an AI-powered virtual telephone receptionist service. The Service includes:
- Automated, AI-driven telephone answering and conversation handling
- Real-time call transcription and summary generation
- Notification delivery (SMS and/or WhatsApp) to the Client's registered mobile number
- A secure online portal for Clients to review call history, transcripts, and account information
- A dedicated telephone number assigned exclusively to each Client
- Configurable AI persona name, greeting, and business-specific knowledge
- Simultaneous call handling (the Service is capable of handling multiple concurrent inbound calls)
The Service operates 24 hours a day, 7 days a week, 365 days a year. Planned maintenance windows will be communicated with reasonable notice where practicable.
3. Subscription & Billing
3.1 Subscription Plans. The Service is provided on a monthly subscription basis. Current pricing is displayed on the BrilliantFixCalls.com pricing page and is subject to change with 30 days' prior notice.
3.2 Billing Cycle. Your subscription renews automatically every 30 days from your original activation date. You will be charged the applicable subscription fee at the start of each billing cycle.
3.3 Currency. Clients based in the United Kingdom are billed in Pounds Sterling (GBP). Clients based in the United States are billed in US Dollars (USD). The Company reserves the right to determine applicable currency based on the Client's registered location.
3.4 Payment Processing. Payments are processed securely via PayPal. By subscribing, you authorise us to charge your selected payment method on a recurring 30-day basis. The Company does not store card details on its servers.
3.5 Failed Payments. If a payment fails, we will attempt to notify you. Access to the Service may be suspended if payment is not received within 7 days of the due date.
3.6 Refunds. Monthly subscription fees are non-refundable unless the Company has failed to provide the Service as described. Refund requests must be submitted in writing to hello@brilliantfixcalls.com within 14 days of the relevant billing date.
3.7 Price Changes. We reserve the right to modify subscription pricing. All pricing changes will be communicated via email at least 30 days in advance.
4. Client Obligations
By subscribing to the Service, the Client agrees to:
- Provide accurate, complete, and current registration information including business name, address, and contact details
- Maintain the confidentiality of account login credentials and notify us immediately of any unauthorised access
- Use the Service only for lawful business purposes in compliance with all applicable laws and regulations
- Not use the Service to engage in fraudulent, deceptive, harassing, or unlawful communications
- Provide accurate business information to allow proper AI configuration
- Ensure that their use of the Service complies with UK GDPR, the Data Protection Act 2018, and any applicable data protection legislation in their jurisdiction
- Inform their own customers that calls may be handled by an AI-powered system where legally required to do so
- Provide valid business registration documentation upon request (required for telephone number regulatory compliance)
5. Acceptable Use Policy
The Client must not use the Service to:
- Conduct outbound cold-calling, telemarketing, or robocalling campaigns
- Deceive End Users in a manner that causes harm
- Collect personal data beyond what is necessary for the stated business purpose
- Engage in any activity that violates the Telephone Preference Service (TPS) or equivalent regulations
- Resell, sublicense, or redistribute access to the Service without written consent from the Company
- Attempt to reverse-engineer, circumvent, or interfere with the technical operation of the Service
- Upload or transmit malicious code, viruses, or harmful content via the Platform
Violation of this Acceptable Use Policy may result in immediate suspension or termination of the Client's account without refund.
6. Data Processing & Privacy
6.1 Data Controller. BrilliantFix Limited acts as the Data Controller in respect of Client account data and as a Data Processor in respect of End User call data processed on behalf of the Client.
6.2 Call Recordings & Transcripts. The Service generates transcripts and summaries of calls. These are stored securely and accessible only to the Client via their portal and to authorised Company staff for support and compliance purposes.
6.3 Retention. Call transcripts and summaries are retained for a period of 12 months from the date of the call, after which they are securely deleted.
6.4 Your Rights. Clients and their End Users have rights under UK GDPR including the right to access, rectification, erasure, and portability of their personal data. Requests should be directed to hello@brilliantfixcalls.com.
6.5 Full Privacy Policy. Our full Privacy Policy is available at brilliantfixcalls.com/privacy and forms part of these Terms.
7. Intellectual Property
7.1 Ownership. All intellectual property rights in the BrilliantFixCalls™ platform, software, AI systems, branding, and content are owned exclusively by BrilliantFix Limited or its licensors.
7.2 Limited Licence. We grant the Client a limited, non-exclusive, non-transferable, revocable licence to access and use the Service during the Subscription period for their internal business purposes only.
7.3 Restrictions. The Client may not copy, modify, distribute, sell, or lease any part of the Service, nor may they reverse-engineer or attempt to extract the source code of the Service.
7.4 Client Content. The Client retains all rights to business information, descriptions, and materials provided to configure the Service. By providing this information, the Client grants BrilliantFix Limited a limited licence to use it solely for the purpose of providing the Service.
8. Limitation of Liability
8.1 To the maximum extent permitted by applicable law, BrilliantFix Limited shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Service.
8.2 The Company's total liability to the Client in any 12-month period shall not exceed the total Subscription fees paid by the Client during that period.
8.3 We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated responses will be perfectly accurate. The AI is a tool to assist, not replace, human judgement.
8.4 Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
9. Termination
9.1 By Client. You may cancel your subscription at any time by contacting hello@brilliantfixcalls.com or via your client portal. Cancellation takes effect at the end of the current billing cycle. No partial refunds are issued for unused days in a billing period.
9.2 By Company. We may terminate or suspend your account immediately and without notice if you breach these Terms, fail to pay subscription fees, or use the Service unlawfully.
9.3 Effect of Termination. Upon termination, your access to the Platform will cease. Your call data will be retained for 30 days post-termination to allow data export, after which it will be permanently deleted.
10. Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
We aim to resolve disputes informally in the first instance. Please contact hello@brilliantfixcalls.com before commencing legal proceedings.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email to registered Clients at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
Trademark Notice
BrilliantFixCalls™ and the BrilliantFixCalls logo are trademarks of BrilliantFix Limited, registered in England and Wales (Company Number pending registration). All rights reserved.
BrilliantFix™ and all related marks, logos, and trade names are the exclusive property of BrilliantFix Limited. Unauthorised use, reproduction, imitation, or misappropriation of these trademarks — in whole or in part — in any medium or format, whether commercial or non-commercial, is strictly prohibited and may constitute trademark infringement, passing off, and/or unfair competition under the laws of England and Wales and international intellectual property treaties.
The following marks are protected under BrilliantFix Limited's trademark rights:
- BrilliantFixCalls™ — word mark in all classes relating to AI communication services, telephone reception, and SaaS platforms
- BrilliantFix™ — word mark in all classes relating to technology services and business solutions
- The BrilliantFixCalls phone-and-signal logo mark
- The stylised "BFC" monogram
- All associated taglines, including "Your Receptionist That Never Misses a Call"
Third parties may not use these marks or any confusingly similar marks in connection with products or services that are not those of BrilliantFix Limited, or in any manner that is likely to cause confusion, mistake, or deception among the public, or that disparages or discredits BrilliantFix Limited.
Permission to use BrilliantFix Limited's trademarks in any form must be obtained in writing from BrilliantFix Limited. Requests should be directed to: hello@brilliantfixcalls.com
All other trademarks, product names, and company names or logos cited herein are the property of their respective owners. BrilliantFix Limited makes no claim to rights in any third-party trademarks.
GDPR & Data Protection Compliance
BrilliantFix Limited is fully committed to compliance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and the EU General Data Protection Regulation (EU GDPR 2016/679) where applicable.
Legal Basis for Processing. We process personal data under the following legal bases as defined in Article 6 UK GDPR:
- Contract: Processing necessary for the performance of our subscription contract with Clients
- Legitimate Interests: Processing call data for the purpose of delivering the AI reception service on behalf of Clients
- Legal Obligation: Retention of records as required by law
- Consent: Where expressly obtained for specific marketing communications
Data Subject Rights. Under UK GDPR, individuals have the following rights, which BrilliantFix Limited fully upholds:
- Right to be informed about how personal data is used
- Right of access to personal data held about them
- Right to rectification of inaccurate data
- Right to erasure ("right to be forgotten")
- Right to restriction of processing
- Right to data portability
- Right to object to processing
- Rights related to automated decision-making and profiling
To exercise any of these rights, please email hello@brilliantfixcalls.com with the subject line "Data Subject Request". We will respond within 30 days in accordance with our legal obligations.
Data Security. We implement appropriate technical and organisational measures to protect personal data against unauthorised or unlawful processing and against accidental loss, destruction, or damage, including encryption at rest and in transit, access controls, and regular security assessments.
Data Transfers. Where personal data is transferred outside the UK or EEA, we ensure appropriate safeguards are in place in accordance with Chapter V UK GDPR.
